Cleaning databases for the Telephone Preference Service

In July 2004 new legislation was introduced making it illegal to cold call companies who have registered their business with the NEW Corporate Telephone Preference Service. The days of sales people creating mailing lists by copying numbers from directories are over.

Whilst this may be a relief to many of us who get bombarded with calls everyday, it does result an increase in the cost of our own sales efforts. We now need to check all of our sales lists against the TPS or risk legal action.

Don’t be fooled into thinking that because the Mailing Preference Service hasn’t worked that this won’t work either. Unlike the TPS the MPS is not a legal requirement. Ignore this legislation at your peril.

The Business to Business Telemarketing and Electronic Communication Regulations 2003.

Corporate Subscribers will now be able to register their numbers on the TPS to opt out of receiving unsolicited direct marketing calls. Direct Marketers will be obliged to screen data as frequently as is necessary to ensure that nobody protected by the Regulations, who has registered 28 days or more previously, is contacted.

The Corporate Telephone Preference Service (CTPS) begins from 25 June 2004. The CTPS Data File contains telephone numbers only from corporate bodies such as limited companies in the UK, limited liability partnerships in England, Wales and Northern Ireland or any partnership in Scotland. It also contains schools, government departments and agencies, hospitals and other public bodies.

Telephone Preference Service for individuals

Under Government legislation introduced on 1 May 1999 it became unlawful to make unsolicited direct marketing calls to individuals who have indicated that they do not want to receive such calls.

People can register with the TPS to stop this activity. Direct Markers are prevented by law from mailing anyone on the Telephone Preference Service.
